JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2019 This application has been filed for modification of order dated 07.03.2019 passed in Cr. Misc. No. 168 of 2019, by which, the prayer of the petitioner for grant of pre arrest bail was disposed of with direction to the petitioner to surrender in the court below within a period of eight weeks with a bank draft of Rs. 85,000/- drawn in favour of opposite party no. 2 and on depositing the amount, the court below was directed to release the petitioner on bail.

It has been submitted by learned counsel for the petitioner that due to illness, the petitioner could not surrender within the time prescribed by this Court vide order dated

Patna High Court CR. MISC. No.33978 of 2019(2) dt.21-06-2019 2/2 07.03.2019 and prayed for extension of time to surrender in the court below.

Heard learned APP also.

Considering the averments made in the modification application and also the submission of learned counsel for the petitioner, order dated 07.03.2019 passed in Cr. Misc. No. 168 of 2019 is modified to the extent that further two weeks' time from the date of receipt of this order, is allowed to the petitioner to surrender in the court below.

All other condition mentioned in the order dated 07.03.2019 passed in Cr. Misc. No. 168 of 2019 shall remain intact.

With the above observation, this modification application is allowed.
