Heard learned counsel for the petitioners and learned APP for the State.
The petitioners seek bail in a case registered under Sections 461, 379/34 of the Indian Penal Code. Allegedly, theft of 20 bags of plaster of paris of Indigo and Sitkani company each bag containing 20kg./25 kg. was committed.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no
Patna High Court CR. MISC. No.34691 of 2020(2) dt.19-01-2021 2/2 allegation of tampering of witnesses alleged against the petitioners. The petitioners have been falsely implicated in the present case. The petitioner Nos. 1 & 2 are in custody since 1206-2020 and 16-06-2020 respectively. Charge sheet/Prosecution report in this case has already been submitted. The petitioners have remained in custody for more than six months. The offences are triable by the Magistrate.
On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Araria in connection with Raniganj P.S.
