Petitioner is accused in connection with Buxar(M) P.S. Case No. 40 of 2015 registered under Sections 302/34 of the I.P.C. and 27 of the Arms Act.
Accusation is that Guddu Choudhary, son of the informant after taking dinner went to sleep at his newly constructed house where his relative Balamay Choudhary had also gone to sleep. In the night, Balamay Choudhary came and informed that two persons came and fired upon Guddu during sleeping. Thereafter, the informant went there along with villagers and found his elder son Guddu Choudhary died sustaining dire arm injury at his chest. The informant raised suspicion against the
Patna High Court Cr.Misc. No.51420 of 2015 (2) dt.21-12-2015 2/2 petitioner and one Raja Choudhary, having their hand in killing of his son due to land dispute.
Learned counsel appearing on behalf of the petitioner submits that submitted that there is no eye witness of the occurrence. Only suspicion has been raised by the informant against the petitioner showing his involvement with co-accused Raja Choudhary. It is also submitted that co-accused Raja Choudhary has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 18638 of 2015 on 03.09.2015. Petitioner is in custody since 18.02.2015.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Buxar in connection with Buxar (M) P.S. Case No. 40 of 2015. (Rajendra Kumar Mishra, J) Shail/- U T
