The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 342, 147, 148, 149, 323 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act. It is alleged that the petitioners and others assaulted the informant and abused him.

It is submitted by learned counsel for the petitioners that no injury was caused to the informant and for the occurrence of 04.10.2015 at 8.00 P.M. the FIR was registered on

Patna High Court Cr.Misc. No.4742 of 2016 (2) dt.04-02-2016 2/2 05.10.2015 at 4.00 P.M. Subsequently the informant has retracted from the initial version and filed a petition to that effect before the learned court below.

A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the retracted version of the informant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Motihari, East Champaran in connection with Kalyanpur P.S. Case No. 290 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
