JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Bausi P.S. Case No. 51 of 2021, registered for the offence punishable under Section 394 of the Indian Penal Code.

As per the prosecution case, two unknown miscreants riding on motorcycle intercepted the informant and assaulted him by iron rod on his head, looted cash, CSP agreement paper, ATM and other articles.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. Name of petitioner has come in this case during course of investigation and the police recorded confessional statement of petitioner in which recovery of ATM card, CSP agreement paper and cash and motorcycle of

Patna High Court CR. MISC. No.45758 of 2021(3) dt.04-01-2022 2/2 informant was shown. Petitioner is in custody since 23.05.2021 having no criminal antecedent.

Learned APP however, vehemently opposed the prayer for bail and submitted that looted articles, cash etc. of informant has been recovered from possession of this petitioner. Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
