JUSTICE SHIVAJI PANDEY ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner, for the State and for the informant.

In this case, petitioner is seeking bail in Pakribarawan P.S.Case No. 51 of 2015 registered u/s 147, 148, 149, 341, 323, 307, 379, 504 and 507 IPC and 27 of the Arms Act. There is land dispute between the parties. The informant had made a proposal that after measurement whoever will be found entitle4d, will be given possession of the land and that led to firing by the petitioner which hit the informant. Counsel for the petitioner submits that cartridge did not hit on the vital portion of the body and it cannot be a case of Section 307 IPC.

Counsel for the informant submitted that the

Patna High Court Cr.Misc. No.49147 of 2015 (2) dt.04-11-2015 2/2 informant could save his life by slanting his body. In such view of the matter, this Court is not inclined to grant bail to the petitioner. This petition is, accordingly, dismissed. However, if so advised, petitioner may renew the prayer after nine months' custody.
