====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 29-01-2021 Heard learned counsel for the petitioners and learned counsel for the State.

In this case, the petitioners are seeking regular bail in connection with Mali P.S. Case No. 95 of 2020 registered for offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act.

The police has recovered 106.5 litres of liquor from a house adjacent to the poultry farm of one Vinod Yadav. Learned counsel for the petitioners submits that the petitioner no. 1 is a driver and the petitioners have no concern with the said liquor, inasmuch as they are in custody since

Patna High Court CR. MISC. No.33916 of 2020(2) dt.29-01-2021 2/2 18.08.2020, having clean antecedent.

Looking to the period of custody and petitioner having clean history, let the petitioners above named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of 7th Additional Sessions Judge-cum-Special Judge (Excise), Aurangabad in connection with Mali P.S. Case No. 95 of 2020, subject to the condition that one of the bailors of the petitioners shall be their close relative. The petitioners will not induce any witness or tamper with the evidence. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court. If the petitioners are found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below and the court below will take decision in accordance with law.
