The petitioner is languishing in jail since 06.06.2015 in a case instituted under Sections 409 and 420 of the Indian Penal Code.

As per allegation, it is a case of misappropriation of money by the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.06.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner has been made accused due to mistake of fact. Patna High Court Cr.Misc. No.37015 of 2015 (3) dt.06-10-2015 completed. Petitioner is the headmaster of the concerned school. It has further been submitted that the petitioner is ready to deposit an amount of Rs.20,000/- in the court below which shall be final disposal of the case.

On behalf of the State, it has been submitted that the petitioner is named in the FIR and there is allegation of misappropriation of the public money.

Considering the aforesaid facts, it is directed that the petitioner shall deposit an amount of Rs.20,000/- in the court below which shall be final disposal of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Kishanganj in connection with Kochadhaman P.S.Case No.41 of 2015.
