This application for grant of anticipatory bail arises out of Kotwali P.S. Case No. 615/2015, disclosing offences under sections 406, 420, 465, 468 of the Indian penal Code. It is alleged that the petitioner got advance car loan in her favour on the basis of certain documents, which were found to be forged.

While denying the allegation in the First Information Report, learned counsel for the petitioner submits that since the allegation is based on documentary evidence, there is no chance of the petitioner tampering with the evidence or fleeing from the course of justice. He further submits that the Bank has taken

Patna High Court Cr.Misc. No.5412 of 2016 (2) dt.09-03-2016 recourse to criminal prosecution in order to put undue pressure for recovery of the loan from the petitioner.

Considering the facts and circumstances and the nature of accusation, this application is allowed.

Let the petitioner, abovenamed, in the event of her arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in Kotwali P.S.Case No. 615/2015, subject to the conditions as laid down under section 438(2) of the Cr.P.C.

This is subject to the condition that the petitioner shall present herself before the police/ court, as the case may be, as and when required and in the event of failure on her part to appear before the court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
