JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner along with other accused is named in the FIR with accusation that he as well as other accused mercilessly assaulted the deceased with Lathi, Danda, first and slaps as a result of which the informant's wife died then and there, but the inquest report of the deceased shows that no apparent injury was found on the person of the deceased and similarly, the Doctor who conducted the post mortem on the corpse of the deceased, also did not point out any physical injury and the opinion regarding the cause of death of the deceased was kept reserved till the receipt of the report of viscera examination. Moreover, some witnesses stated that the deceased consumed

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kudhani P.S. Case No. 155/2014, G.R. No. 1214/2014 to the satisfaction of the Sub-Divisional Judicial Magistrate, Muzaffarpur West.
