Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered in connection with Daraunda P.S.Case No. 18 of 2017 arising out of Garhpura P. S Case No. 25 of 2020 for the offences punishable under Section 302 /34 of the Indian Penal Code . Learned counsel for the petitioner submits that allegation levelled against the petitioner is false and fabricated, petitioner is innocent and has been falsely implicated in the present case with ulterior motive.
A report was called for with regard to present state of trial. The report dated 05.01.2022 of learned Additional Session
Patna High Court CR. MISC. No.47299 of 2021(3) dt.12-01-2022 2/2 Judge Vth Siwan has been received. It would appear from perusal of the aforesaid report that prosecution evidence has been closed. The aforesaid report further reveals that defence evidence has already been closed and case record is presently fixed for argument on behalf of the defence.
Considering the aforesaid facts and circumstances of the case, I am not inclined to grant privilege of bail to the petitioner and accordingly, his prayer for bail in connection with Daraunda P.S.Case No. 18 of 2017, pending in the court of learned Additional Sessions Judge, VII, Siwan stands rejected.
