Petitioner seeks bail in a case registered for the offences punishable under Sections 393 of I.P.C. and 25(1b)A/26/35 of Arms Act. The police got telephonic information that some miscreants are robbing to the passersby. When the police reached there, the petitioner was found in an injured condition and from possession of the petitioner, a pistol was recovered. The villagers thereat reported that one Jitendra Kumar was returning to his village and three motorcycles-borne criminals attempted to rob him, however, one of them was apprehended by the people who was this petitioner.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He is in custody since 19.07.2020. Investigation of the case is already complete. No other incriminating article and looted property was recovered

Patna High Court CR. MISC. No.33907 of 2020(3) dt.09-02-2021 2/2 from his possession. The petitioner is victim of suspicion. Statement of said Jitendra Kumar was never recorded by the police.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with G.R.No.3040 of 2020 arising out of Minapur (Panapur O.P.) Police Station Case No.266 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
