2. The present Criminal Miscellaneous Application has been filed under Section 482 of The Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as "BNSS, 2023") for grant of anticipatory bail to the petitioner who apprehends his arrest in connection with Sangrampur P.S. Case No.109 of 2023, for the offences punishable under Sections 147, 149, 353 & 290 of the IPC read with section 3⁄4 of the Damage to Public Property Act.
3. As per the prosecution, FIR has been lodged against 5 named accused persons and 15-20 unknown accused persons including the present petitioner against whom there is allegation
Patna High Court CR. MISC. No.34945 of 2025(3) dt.20-08-2025 2/3 that they have assaulted the police party and put fire in the rubber tyre on the road and stopped the common movement of the public at large.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that due to accident took place, the protestors reached there and in the anger, they stopped the movement due to inaction on the part of the police. But the police on the part of doing his duty, the solution was to file a criminal case against the innocent person.
5. Counsel submits that the criminal antecedent of the petitioner is clean and two accused persons have been granted anticipatory bail by the Co-ordinate Bench of this Court vide orders dated 02.08.2023 & 14.02.2025 passed in Cr.Misc. Nos. 42232 of 2023 and 6865 of 2025.
6. Counsel further submits that such mistake shall not take place in future.
7. Learned APP for the State opposes the prayer for bail of the petitioner.
8. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the
