JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2016 Heard learned counsel for the petitioner and the State. The petitioner being father of the husband of the victim is apprehending in a case under Section 304-B/34 of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant after 4 years of marriage for non fulfillment of dowry demand by administering poison.

It is submitted by learned counsel for the petitioner that the thrust of accusation is against the husband of the victim. The petitioner claims to be separate from the husband of the victim since long. The postmortem report reflects that though abrasion and laceration have been found on the left eye, neck and the lip of the victim but the cause of death has not been

Patna High Court Cr.Misc. No.4712 of 2016 (2) dt.04-02-2016 2/2 ascertained and the viscera report has been preserved and the report is awaited.

Considering the thrust of accusation against the husband of the victim let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/ (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Patna City, in connection with Fatuha P.S. Case No. 256 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
