Petitioner seeks regular bail in a case registered for the offence punishable under Section 394, 302, 201/34 of the Indian Penal Code.
As per the prosecution case, the younger brother of informant was killed by pressing his neck and mouth. Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner sprang up in this case during the course of investigation in the confessional statement of co-accused, Rajesh Kumar and Santosh Kumar Singh, who have already been granted bail by different Benches of this court vide orders passed in Cr. Misc.
Patna High Court CR. MISC. No.46740 of 2021(3) dt.07-01-2022 2/2 No. 22601/2012 and 26328/2012. Save and except confessional statement of co-accused, there is no direct or indirect material against this petitioner to show his complicity in the aforesaid crime. Petitioner is in custody since 08.02.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Rosera, Samastipur in connection with Singhiya PS case No.124/2011.
