In this case, the petitioner is apprehending his arrest in connection with Durgawati P.S. Case No. 375 of 2018 (G.R. No. 2704 of 2018) registered for offences under sections 356, 379 of the Indian Penal Code but later on amended Sections 395, 412 of the Indian Penal Code.

As per First Information Report, while the Informant after collection was coming back to Durgawati on motorcycle, two persons, coving their face, came there on an Apachi Motorcycle, and snatched away his bag containing cash amounting Rs. 1,02,450/-, A.T.M. Card, Driving License, Adhar Card, Pan Card etc.

Patna High Court CR. MISC. No.37754 of 2019(2) dt.21-06-2019 2/2 Learned counsel for the petitioner submits that the name of the petitioner has transpired during investigation. The petitioner has criminal antecedent of the similar nature of offence.

Looking to the nature of offence as also the petitioner having criminal antecedent, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. If the petitioner surrenders before the court below within a period of three weeks from today and makes a prayer for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law.
