2. The petitioner has preferred this application for grant of regular bail in connection with Ahiyapur P.S. Case No. 1735 of 2024 dated 26.12.2024 registered for the offences punishable u/ss 105, 319(2), 318(4), 316(2), 61(2) of the BNS.
3. As per the prosecution case, the informant's sisterin-law who was a pregnant woman, was admitted in SKMCH, Muzaffarpur and in the meantime, a person came and asked the informant to admit the patient in the Max Hospital for better treatment. It is further alleged that the informant's sister-in-law, died in the hospital due to carelessness of the petitioner, the Max hospital and its administration and management. It is further

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up on mere suspicion. There is general and omnibus allegation against the petitioner. There is no overt act against the petitioner. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 02.03.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner is the co-owner of the said hospital.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Muzaffarpur in connection with Ahiyapur P.S. Case No. 1735 of 2024, with a condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable
