Petitioner seeks bail in Baunsi P.S. Case No.214 of 2020 registered under Section 414 of the IPC and under Section 30(a) of the Bihar Prohibition and Excise Act. The informant (S.H.O. of Baunsi P.S.) got secret inputs that a trader of liquor was transporting the liquor from Jharkhand to Bhagalpur on an ambulance. The informant intercepted the ambulance and recovered 141.900 litres of Indian made foreign liquor. The driver, the cleaner of the ambulance and the petitioner were arrested. The petitioner was sleeping inside the ambulance and Rs.430/- was recovered from possession of the petitioner. The petitioner is in jail since 27.08.2020. The petitioner has remained in jail for more than four and half months.

No.34381 of 2020(2) dt.15-01-2021 2/2 Taking into consideration the facts that the petitioner was traveling in the vehicle but he had no knowledge about the liquor kept in the ambulance and the petitioner is in jail for more than four and half months, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge II, Banka in connection with Baunsi P.S. Case No.214 of 2020.
