The petitioner is in custody in connection with Vidhyapati Nagar P.S. Case No. 39 of 2019, registered for the offence punishable under Sections 272, 273 of the I.P.C. and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that in the instant case total 117 liters 675 ml of foreign liquor was recovered. He further submits that nothing was recovered from his conscious physical possession. Learned counsel for the petitioner would submit that petitioner is in custody in this case since 05.04.2019.

Considering the facts that petitioner has no criminal

Patna High Court CR. MISC. No.34554 of 2019(2) dt.27-05-2019 2/2 antecedent and he has remained in custody for more than 1 1⁄2 months, let the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Addl. Sessions Judge 2nd, CumSpecial Judge, (Excise) Samastipur in connection with Vidhyapati Nagar P.S. Case No. 39 of 2019.
