Heard learned counsel for the petitioners and the learned APP for the State.

The petitioners apprehend their arrest in connection with Birpur P.S. Case no. 91 of 2021 registered under section 306/34 of the Indian Penal Code.

The present case has been lodged for abetment of suicide to the deceased as well as section 498A of the Indian Penal Code.

Learned counsel for the petitioners has submitted that

Patna High Court CR. MISC. No.47135 of 2021(2) dt.17-05-2022 2/2 son of the petitioners eloped the daughter of the informant and thereafter they solemnized marriage. The marriage was socially recognized but after that case under section 498A IPC was filed which was compromised. After compromise, son of the petitioners took the deceased to his home and couple were residing there. He has also submitted that petitioners have no role in the alleged occurrence.

Considering the above mentioned facts and circumstances, the petitioners above named, in the event of arrest or surrender within four weeks from today, are directed to be released on bail on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Birpur, Supaul in connection with Birpur P.S. Case no. 91 of 2021 subject to condition as laid down under section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which the matter shall be brought to the notice of this Court.
