JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 341, 323, 354(B) of the Indian Penal Code and u/s 12 of POCSO Act.

As per the prosecution case, while the minor daughter of informant was cutting grass, this petitioner caught her shoulder and tried to drag and disrobe her.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case due to family dispute. No such occurrence, as alleged in the FIR, has taken place. Petitioner is next door neighbour of informant. Petitioner claims clean antecedent and is in custody since 21.06.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the
