JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, the informant along with her daughter and husband had gone to Daniyawa to make payment of Rs. Four lakhs and when her husband reached near Chhapak Water Park on the way of Patna Bakhtiyarpur road some unknown persons shot him dead.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation on the basis of information of police spy and mobile tower location of

Patna High Court CR. MISC. No.47083 of 2021(2) dt.18-11-2021 2/2 petitioner and co-accused, Bimlesh Giri and thereafter this petitioner and co-accused Bimlesh Giri have been arrested and they confessed their guilt and except the confessional statement, which has no evidentiary value, there is no other material against this petitioner to show his complicity in the aforesaid crime. Petitioner is in custody since 27.03.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-1, Patna City, Patna in connection with Fatuha PS case No.222/2021.
