The petitioner seeks bail in connection with Karai Parsurai P.S. Case No.136 of 2014 registered under Sections 304(B)/34 of the Indian Penal Code.
The informant, Pintu Paswan, has made allegation that his daughter, Madhu Devi, was being tortured by her husband (petitioner) and other in-laws after the marriage. On 25.09.2014, Nitish Kumar, brother-in-law of his daughter, threw burning lamp at the body of his daughter and consequently she got burn injury and, thereafter, she was rushed to the P.M.C.H. by her in-laws including the petiitoner but during the course of treatment she died

Learned counsel appearing on behalf of the petitioner submits that the petitioner happens to be the husband of the deceased, the daughter of the informant. It would appear from the F.I.R. that the allegation of throwing the burning lamp at the body of the deceased is against Nitish Kumar, the brother-in-law of the deceased, and not against this petitioner. It is also submitted that after sustaining burn injury by the deceased, she was rushed to the P.M.C.H. for treatment by her in-laws including the petiitioner where she died after eight days of the occurrence. The petitioner is in jail custody since 22.11.2014.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa, District-Nalanda, in connection with Karai Parsurai P.S. Case No.136 of 2014.
