JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-02-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 147, 148, 149, 353, 307, 124 (A) and 506 of the I.P.C, section 27 of the Arms Act, section 17 of C. L.A. Act and sections 3, 4 and 5 of the Explosive Substances Act. The petitioner is named in the FIR but name of the petitioner has come in this case on the fact that the extremists were calling the names of each other, nothing has been recovered from possession of the petitioner and other co-accused, namely, Chhotu Das @ Avinash @ Shiv Nandan Das, Chanarik Ravidas @ Chanarik Jee @ Chandan Jee, Rekha Jee @ Rekha Yadav and

Patna High Court Cr.Misc. No.51889 of 2015 (4) dt.17-02-2016 2/2 Bhutali Ji @ Dhanik Lal Mandal have already been allowed bail by another coordinate Bench of this Court.

In the facts and circumstances as stated above, the above named petitioner is also directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. Sherghatti (Gaya) in Imamganj P.S. Case No. 110 of 2012, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
