Heard learned counsel for the petitioner and the State. The petitioner seeks confirmation of bail granted to him vide order dated 17.8.2015 in a case instituted under Section 498A of the Indian Penal Code. Allegation against the petitioner along with others is to have tortured and lastly ousted informant from matrimonial house due to non-fulfilment of demand of dowry.
It has been submitted on behalf of the petitioner that he is husband of opposite party no. 2. Notice was issued to opposite party no. 2 vide order dated 17.8.2015. Service report dated 6.10.2015 indicates that notice under ordinary process was received by opposite party no. 2 personally.
When the matter was called out, no one appeared on behalf of opposite party no. 2.
Patna High Court Cr.Misc. No.32510 of 2015 (3) dt.07-10-2015 2 / 2 Taking into account the aforesaid facts and circumstances of the case, bail granted to the petitioner vide order dated 17.8.2015 in connection with Complaint Case no. 2745 of 2012 corresponding to Trial no. 4097 of 2015 pending in the court of C.J.M., Siwan, is confirmed.
