JUSTICE SUDHIR SINGH ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302 and 201/34 of the Indian Penal Code. Allegation against the petitioner is that he along with other persons committed murder of her daughter and threw out the dead body near pillar no. 7 of Rewaghat Bridge over river Ghandak.
It has been submitted on behalf of the petitioner that he is in custody since 18.3.2015. Chargesheet has been submitted in the case. Petitioner is said to have been made accused due to mistake of fact. There is no eye witness to the occurrence. Merely on the basis of suspicion the petitioner has been named in the present case.
On behalf of the State, it is submitted that the petitioner is none but father of the deceased girl against whom there is allegation of committing murder of his own daughter. Several paragraphs of the case diary have been referred on behalf of the
Patna High Court Cr.Misc. No.35847 of 2015 (3) dt.07-10-2015 2 / 2 State.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner, same is rejected. Anyhow the trial court is directed to take all necessary steps to expedite the trial in connection with Maker P. S. Case no. 30 of 2013 and conclude the same preferably within a period of one year from the date of receipt/production of a copy of this order.
