JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 25-08-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceeding. Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in connection with Chiksaura P.S. Case No.38 of 2020 registered for the offence punishable under Sections 341, 323, 307, 353, 379, 504, 506, 34 of the Indian Penal Code and section 302 IPC was added later on. Earlier the bail application of the petitioner was rejected by this Court on merit vide order dated 26.05.2021 passed in Cr. Misc. No.3852 of 2021. Again, on 21.08.2021, the instant bail
Patna High Court CR. MISC. No.47318 of 2021(2) dt.25-08-2021 2/2 application has been filed by the petitioner. Learned counsel for the petitioner submits that charge has been framed but no witness has been examined till date. I find that no fresh ground is taken in the present bail application. Considering the same, since the bail application of the petitioner was rejected on merit on the last occasion and no new ground is taken in the present application, I am not inclined to grant bail to the petitioner.
