JUSTICE SUDHIR SINGH ORAL ORDER 21-12-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 364 302, 201 and 120B/34 of the Indian Penal Code. Allegation against the petitioner is that he was also involved in kidnapping and killing the son of the informant. It has been submitted on behalf of the petitioner that he is in custody since 7.2.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. From perusal of the F.I.R. it would appear that informant is not the eye witness to the alleged occurrence. Merely on the basis of enmity suspicion has been raised against the petitioner. Other co-accused have been granted bail vide Cr. Misc. no. 24899 of 2015, Cr. Misc. no. 35457 of 2015 and Cr. Misc. no. 56393 of 2015.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.49264 of 2015 (3) dt.21-12-2015 2 / 2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-III, Begusarai , in connection with Birpur P.S. Case no. 10 of 2015.
