The petitioner apprehends his arrest in Doriganj P.S. case No. 240/2019 registered under Section 25(1-b)a, 26, 35 of the Arms Act.

The informant S.I. of Doriganj P.S. alleged that while he and other police officers were checking the vehicles, he saw three persons coming on a motor cycle. When the motorcyclists were signaled to stop the driver of the vehicle turned the vehicle and started fleeing away. One person fell down from the motor cycle who was apprehended and apprehended accused person disclosed his name as Ravindra Kumar and from his possession one loaded country made pistol with live cartridge was recovered.

The learned counsel for the petitioner submits that

The name of petitioner surfaced in the case in the disclosure made by Ravindra Kumar that petitioner and one another managed to flee away from the vehicle but the police even did not enquire about the vehicle No. but it appears that petitioner has got criminal antecedent and he is accused in Chapra Muffasil P.S. case No. 14/2019 registered u/s 414 of the IPC and u/s 25(1-b) a, 26, 35 of Arms Act.

Taking into consideration the facts aforesaid and the fact that petitioner has got criminal antecedent, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
