The petitioner seeks bail in case under Section 20 of Narcotics Drugs and Psychotropic Substance Act. The prayer for bail of the petitioner was earlier rejected vide order dated 04.03.2015 passed in Cr. Misc. No. 45328 of 2014 with a direction to the trial Court to expedite the trial and conclude the same within six months from the date of receipt/production of a copy of the aforesaid order.
It appears from the order of the learned Sessions Judge that the aforesaid order was received in the Court on 27.03.2015 but out of 10 witnesses, only 3 witnesses have been examined for recovery of 10.500 Kg of ganja. The petitioner remained in jail since 28.07.2014. The petitioner has already remained in jail for one year and four months.
Patna High Court Cr.Misc. No.48662 of 2015 (2) dt.02-12-2015 P2/2 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Bhojpur at Ara in connection Ara Muffasil P.S. Case No. 157 of 2014, subject to the condition that one of the bailors shall be a local having substantial immoveable property and the petitioner shall appear on each and every date during the course of trial failing which the trial court shall be at liberty to cancel the bail bonds of the petitioner.
