2. The petitioner seeks bail in connection with Ramgarh ( Nuaon) P.S. Case No. 480 of 2024 registered for the offence punishable under Sections 126(2), 115(2), 103, 352 and 3(5) of the Bharatiya Nyaya Sanhita.

3. Though in the FIR, there is general and omnibus allegation against four persons but in the re-statement, the informant has said that it is the petitioner who had given the fatal blow upon the deceased and the deceased died. The father of the petitioner, who is a co-accused has been granted bail.

4. The petitioner is in custody since 22.02.2025.

5. Learned Senior Counsel for the petitioner submits

Patna High Court CR. MISC. No.34249 of 2025(4) dt.08-10-2025 2/2 that no offence under Section 302 of the Indian Penal Code is made out against the petitioner as it appears that the occurrence has taken place on a grave and sudden provocation in which the deceased sustained injury.

6. Learned counsel for the informant has vehemently opposed the prayer for bail.

7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- II, Kaimur at Bhabhua in connection with Ramgarh (Nuaon) P.S. Case No. 480 of 2024.
