Petitioner is in custody in connection with Athmalgola P.S. Case No. 336 of 2018 for the offence under sections 385, 406, 419, 420/34 of the Indian Penal Code.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

Allegation against this petitioner is that he fraudulently got transferred Rs. 6,69,000/- in his own account from the account of mother of the informant. Considering the totality of the facts situation, the Court is inclined to grant bail to the petitioner provided the petitioner shall return back Rs. 6,69,000/- ( Six lacs seventy nine thousand) in installment to the mother of the informant, namely, Most. Munni Devi.

Learned senior counsel appearing on behalf of the

No.45332 of 2019(3) dt.27-09-2019 2/2 petitioner admits that the petitioner is ready to deposit Rs. 1,00,000/- (One lakh) in the court below at the time of release of the petitioner and he will deposit remaining balance amount of Rs. 5,59,000/- (Five lacs fifty nine thousand) in monthly installments of Rs. 50,000/- .

In view of the above, the court below is directed to release the petitioner named above on bail provisionally, if the petitioner deposits Rs. 1,00,000/- in the Court below, on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna, in connection with Athmalgola P.S. Case No. 336 of 2018 subject to the condition that bailors shall be family members of the petitioner and on deposing of the remaining amount i.e. Rs. 5,59,000/- as indicated hereiabove, the provisional bail granted to the petitioner shall be made absolute by the court below.
