ANJANA MISHRA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in Nasirganj P.S. Case No. 127 of 2015 registered for the offences punishable under Sections 406, 420, 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that the present petitioner being wife of the loanee Mukul Raj Chaudhary, took a loan of Rs. 14.80 lakhs and further cash credit of Rs. 8.78 lacs. It is further submitted that the properties were mortgaged in the said loan and his wife was made guarantor. It is alleged that the property which were mortgaged to secure the aforementioned loan, was jointly by the husband as well as present petitioner. Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.4281 of 2016 (2) dt.26-04-2016 2/2 husband was taken into custody and was released vide order dated 09.02.2016 in Criminal Misc. No. 3682 of 2016. Considering the aforesaid facts and circumstances of the case, and in view of the fact that the accused Mukul Raj Chaudhary has been released on regular bail and also on considering the nature of allegation made against the petitioner who is only named as guarantor let the petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is/are directed to be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge 1st Cum ACJM, Bikramganj (Rohtas) in connection with Nasirganj P.S. Case No. 127 of 2015.
