Counsel for the petitioner submits that the present I.A. has been filed with prayer for amendment in the main writ petition by way of adding new relief for quashing the order dated 27.04.2018 contained in Memo No.191 issued under the signature of Secretary to the Commissioner, Patna Division Patna by which minor punishment of censure and withholding of an increment without accumulative effect communicated to the same after getting the status quo vide order dated 27.04.2018 passed in C.W.J.C. No.7757 of 2018 through registered post dated 05.05.2018 with malafide intention.

3. Counsel for the State raised preliminary objection and submits that the order which the petitioner wants to challenge, is appealable/revisionable under Rule 24 of the Bihar Government Servant (Classification, Control and Appeal) Rules, 2005.

4. In this background, the present writ application is hereby disposed off, granting liberty to the petitioner to prefer appeal. Accordingly, the I.A. No.4013 of 2018 is also disposed off.

5. However, the delay, if any in filing the appeal, is directed to be condoned.

6. It is directed that the appellate authority shall decide the appeal within 90 days from the date of appearance of all concerned. Since general election of Lok Sabha, 2024 has been notified, therefore, 90 days shall be counted after end of the election.
