Heard the parties in virtual Court.
Petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of Bihar Prohibition and Amendment Excise Act, 2018.
Petitioner is in custody since 30.07.2020. Petitioner has got no criminal antecedent. Allegation is that from the outside of the wall of the under construction house of the petitioner, liquor was recovered.
Submission is that charges have already been framed. There is no direct material against the petitioner. Considering the facts aforesaid, let the petitioner,
Patna High Court CR. MISC. No.33824 of 2020(2) dt.22-12-2020 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Excise Case No.184/2020 with following conditions:
(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
