====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 28-08-2019 Heard Sri Manjeet Mishra, learned counsel for the petitioner and Sri Harendra Prasad, learned Addl. Public Prosecutor.

This is second attempt for grant of bail on behalf of the petitioner. Earlier, the prayer for bail of the petitioner was rejected on 03.12.2018 vide Cr.Misc. No.70392 of 2018. Learned counsel for the petitioner submits that one of the accused has already been granted bail, vide Cr.Misc.No.54541 of 2018.

In this case, earlier by order dated 03.07.2019, a report was called for from the court below, which has been received and kept at Flag-P. The report contained in letter no.3836/2019 dated 25th July, 2019 makes it clear that the case is still pending for cognizance awaiting test report. In that view

Patna High Court CR. MISC. No.36605 of 2019(4) dt.28-08-2019 2/2 of the matter, the Court is of the opinion that since one of the accused has been granted bail and no progress has taken place, the petitioner may not be detained further.

Accordingly, let the petitioner, namely, Monu @ Monu Kumar be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum- Spl. Judge, Muzaffarpur/ concerned court in connection with Bela P.S. Case No. 25 of 2018.
