JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2022 Though the present writ petition has been filed for quashing the notice/ order dated 23.5.2022, passed by the Circle Officer, Barsoi, Katihar i.e. the Respondent No. 4, in connection with Encroachment Case No. 10/2021-22, however, since the Respondent-State has filed a counter affidavit wherein there is no whisper about passing of the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, this Court deems it fit and proper to dispose of the present writ petition with liberty to the petitioners to file their objections / replies before the Respondent No. 4 in the pending Encroachment Case No. 10/2021-22, within a period of four weeks from today, whereupon the Respondent No. 4 shall consider the same and pass appropriate final orders under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in accordance with law, within a period of eight weeks, thereafter and till
