The petitioner is in custody in a case registered under Sections 376/511 of the Indian Penal Code and Section 7 / 8 of the POCSO Act.

The allegation against the petitioner is of attempting to commit the rape upon the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.6.2015. Charge sheet has been submitted in this case. The petitioner has been made accused in the present case due to mistake of fact. If the prosecution story is accepted then merely an attempt is being said to have been made by him. Further, it is submitted that the petitioner may be released

Patna High Court Cr.Misc. No.37770 of 2015 (3) dt.07-10-2015 2/2 after completion of six months in custody from 17.06.2015. On behalf of the State, it has been submitted that the petitioner is named in the FIR and was apprehended at the spot.

Considering the facts aforesaid, let above named petitioner be released, after completion of six months of custody from 17.06.2015, on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 1st, Gopalganj, in Gopalganj Mahila P.S.Case No. 32 of 2015/ C.I.S. No. 323 of 2015.
