JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-01-2024 The short prayer made by the petitioner in the present writ petition is to grant the benefits of first A.C.P. and second M.A.C.P.

This Court finds from a bare perusal of the records that it is not in dispute that the petitioner has already been granted the benefits of 1st A.C.P. with effect from 11.12.2001 and as far as

Patna High Court CWJC No.1093 of 2021(5) dt.24-01-2024 2/2 the second M.A.C.P. is concerned, it has been admitted by the respondents in the counter affidavit filed in the present case that the petitioner has become entitled to grant of the same with effect from 23.11.2009.

In view of the aforesaid, the Administrator, Bihar State Agriculture Marketing Board, Patna is directed to consider the case of the petitioner for grant of the benefits of the second M.A.C.P. with effect from the due date, as per the prevailing rules and pass a reasoned and a speaking order, within a period of six weeks from today and in case any monetary benefit is found payable to the petitioner, the same shall also be paid to him within the same time frame.

The writ petition stands disposed off on the aforesaid terms.
