JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-10-2022 The present writ petition has been filed seeking the following reliefs:- "A. To issue a writ in the nature of mandamus directing and commanding the Respondents, to remove the encroachment from the Government land (Aam Gairmazarua) appertaining to Khata No.720, survey plot No.1406, 1405 and 1403 situated at village- Nadwan, Masaurhi, District-Patna which is creating great inconvenience to the public at large.

B. To issue a writ in the nature of Mandamus

Patna High Court CWJC No.14401 of 2021(2) dt.21-10-2022 2/2 commanding and directing the Respondents, to complete all formalities regarding the measurement and identification of the Government land in question and to remove all illegal constructions thereupon."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Dhanarua, Masaurhi, District- Patna for redressal of his aforesaid grievances. Liberty so sought, is granted. It is needless to state that in case, the petitioner approaches the Circle Officer, Dhanarua, Masaurhi, DistrictPatna, by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith. The writ petition stands disposed off on the aforesaid terms.
