JUSTICE SUDHIR SINGH ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 15.09.2014 in connection with Sakra P.S. Case No. 204 of 2011 for the offences instituted under Sections 304(B) and 201/34 of the IPC. The accusation is of killing the daughter of the informant by the accused persons for non-fulfilment of dowry demand. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 15.09.2014 and the charge sheet has already been submitted in the case. The petitioner has falsely been implicated in the present case. The said fact is evident from the deposition of the informant which is made in Sessions Trial No. 251 of 2014 which
Patna High Court Cr.Misc. No.38057 of 2015 (3) dt.07-10-2015 2/2 is Annexure-2 to the present application. The informant has denied the allegations levelled in the FIR.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R. and he is the husband of the deceased.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in Sakra P.S. Case No. 204/2011, pending in the court of the learned C.J.M., Muzaffarpur. Anyhow, the Trial Court is directed to take all necessary steps to expedite the trial and conclude the same within a period of six months from the date of receipt/production of copy of this order.
