ANJANA MISHRA ORAL ORDER 06-09-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Hathauri P.S. Case No.95 of 2014 registered for the offence under Section 366A/34 of the Indian Penal Code, pending in the court Shri Deepanshu Shrivastav, learned Judicial Magistrate 1st Class, Rosera.
In the present case, a supplementary affidavit had been filed, stating that the victim girl had married one Birju Paswan and was presently residing at Sherpur Bazar, P.S.- Sherpur Kala near State Bank (in the house of Santoshji) in the district of Ludhiyana, State of Punjab. Accordingly, this Court
Patna High Court Cr.Misc. No.4371 of 2016 (12) dt.06-09-2016 2/2 directed the I.O. of the case to visit the location and trace out the girl.
However, a report has been filed today by the I.O. indicating that the said persons are not residing at Ludhiyana as per the personal verification made by him. It thus appears that a false affidavit was made before this Court only for the purpose of securing anticipatory bail and defeating the cause of justice. Considering the false affidavit made by and on behalf of the petitioners, the present application for anticipatory bail stands rejected.
