1. The issue involved in the present case is with regard to grant of affiliation to Fudo Ganesh Memorial Higher Secondary School, which was rejected earlier vide letter no. 969 D-18 dated 09-10-2018 by the Secretary, Bihar School Examination Board, Patna [for short "B.S.E.B."].

2. Learned counsel for the petitioner submits that as of today all the deficiency for grant of affiliation has been removed by the concerned school.

3. Learned counsel for the respondent / B.S.E.B. submits that fresh proposal for affiliation along with all the

Patna High Court CWJC No.12019 of 2019(4) dt.23-11-2023 2/2 relevant documents regarding criteria having been fulfilled by the petitioner's school may be submitted before the respondent no. 4 / Secretary, B.S.E.B. and if such a proposal is submitted along with requisite fee, the same shall be considered by the B.S.E.B. in accordance with law.

4. In view of the aforesaid submissions, let a fresh proposal along with all the relevant papers and requisite fee be submitted by the petitioner for the purpose of grant of affiliation to the concerned school within a period of four weeks from today and if such a fresh proposal is submitted, the respondent no. 4 / Secretary, B.S.E.B. will consider the same in accordance with law without being prejudiced by the fact that earlier proposal submitted by the petitioner for affiliation was rejected.

5. With the aforesaid observation and direction this writ application stands disposed of.
