JUSTICE SANDEEP KUMAR ORAL ORDER 05-07-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek regular bail in connection with Desari P.S. Case No. 20 of 2022, S.Tr. No. 166 of 2023, registered for the offence punishable under Sections 302, 201, 120(B), 34 of the Indian Penal Code.

Learned counsel for the petitioners submit that the petitioners are innocent and have falsely been implicated in this case. Petitioners are brother in law and are having no concern with the deceased husband. Similarly co-accused have already granted regular bail vide order dated 23.01.2023 in Cr. Misc. No. 39955/2022. Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation and also period of custody, this application is allowed.

Let the petitioners, above named, be released on bail, after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Session Judge-XIth, Vaishali at Hajipur, in connection with Desari P.S. Case No. 20 of 2022, S.Tr. No. 166 of 2023.
