The petitioner seeks bail in Bangaon P.S. Case No. 120 of 2018 corresponding to Special (Excise) Case No. 582 of 2018, instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that recovery has been made from the house of co-accused Vinod Yadav who has already been granted bail by coordinate Bench of this Court vide order dated 28.5.2019 passed in Cr. Misc. 35015 of 2019. It is alleged in the written report that petitioner along with other co-accused was found running away from the spot at the time of conducting raid by the police. Petitioner is in custody since 16.4.2019.

Patna High Court CR. MISC. No.36965 of 2019(2) dt.19-06-2019 2/2 Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge (Excise), Saharsa, in connection with Bangaon P.S. Case No. 120 of 2018 corresponding to Special (Excise) Case No. 582 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
