2. The petitioner seeks bail in connection with Sakurabad P.S. Case No. 42 of 2025 instituted for the offences under Sections 308(2), 308(5) of the BNS.

3. As per the prosecution case, the informant has alleged that in the night of 14.02.2025, three unknown persons threatened the labourers present at the brick kiln and demanded extortion money. It was alleged that all the accused persons were variously armed and they also snatched away the mobile phones of Ravi and Kundan.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case.

Learned counsel for the petitioner submits that general and omnibus allegation has been made against the petitioner. Learned counsel further submitted that petitioner never demanded any extortion from the labourers and nor any extortion amount was paid to him. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.02.2025 and has four criminal antecedents. The co-accused person has already been granted bail by a coordinate Bench of this Court vide order dated 26.05.2025 passed in Cr. Misc. No. 32840 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail, after framing of charge, if not already framed, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sakurabad P.S. Case No. 42 of 2025, subject to the following conditions:

(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.

(III) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
