JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323,324 and 376/511 of the Indian Penal Code.

The prosecution case is that the informant was cooking on 25.10.2015 at 10 A.M. when the petitioner entered into the house and made an attempt to ravish her. When the father of the informant came then he was assaulted by the petitioner. It is submitted by the learned counsel for the petitioner that the accusation has been levelled in the background of pending Title Suit No. 267 of 2014 and for the occurrence of 25.10.2015 at 10 A.M. the FIR was registered on 27.10.2015 at 12.10 P.M.

Patna High Court Cr.Misc. No.4207 of 2016 (2) dt.30-01-2016 2/2 through the written report submitted by the informant. The petitioner filed informatory petition at earlier point of time against the informant side. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the delayed lodging of the case and the accusation being levelled in the background of litigated relationship between the parties, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda at Biharsharif in connection with Mahila P.S. Case No.142 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
