Mr.Shailendra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-07-2023 Heard the learned counsel for the petitioner as well as Mr. Shailendra Kumar, the learned Additional Public Prosecutor for the State.

The petitioner is seeking regular bail in connection with Barh P.S. Case No. 795 of 2022, registered for offence punishable under sections 25(1-b)a/26/30/35 of the Arms Act. As per allegation, the police, in course of investigation of Patliputra P.S. Case No. 822 of 2022, raided the hotel. Five accused persons were apprehended and from the possession of co-accused Bablu Kumar @ Babli, a pistol and two cartridges were recovered.

The learned counsel for the petitioner has submitted that no arms and ammunition were recovered from the possession of the petitioner. One pistol and two cartridges were

The aforesaid pistol was a licensed one belonging to his brother Munna Kumar, who was a licence holder of that pistol. The petitioner is under since 24.04.2023 and other co-accused persons have been granted bail.

Considering the above-mentioned facts and circumstances as well as period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh (Patna) in connection with Barh P.S. Case No. 795 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to be cancelled.
