JUSTICE SANDEEP KUMAR ORAL ORDER 05-07-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Wazirganj P.S. Case No. 147 of 2023, registered for the offence punishable under Section 414 of the Indian Penal Code and section 30(a), 45 of the Bihar Prohibition and Excise Amendment Act, 2018.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner has no concern with the seized articles. Petitioner is in custody since 17.03.2023.

Learned APP has vehemently opposed the prayer for

Patna High Court CR. MISC. No.38561 of 2023(2) dt.05-07-2023 2/2 bail.

Considering the nature of allegation and also period of custody, this application is allowed.

Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 1, Gaya in connection with Wazirganj P.S.
