Patna High Court CWJC No.9570 of 2024(2) dt.28-06-2024 2/2 NEET Under Graduate Test held in the year 2024, to cancel the examination and to direct conduct of a fresh examination.

2. We apprised the learned counsel for the petitioner that the Supreme Court is seized of the matter and it is also pertinent that the prayer for cancelling the examination has been specifically raised before the Hon'ble Supreme Court, and there is also a prayer made for cancellation of the examination. We also do not see any reason to direct an investigation since already an investigating agency is looking into it. We find the public interest litigation to be more of a publicity induced litigation. We were not inclined to entertain the writ petition.

3. The learned counsel for the writ petitioner then sought for withdrawal of the writ petition. The writ petition is dismissed as withdrawn with caution to the writ petitioner not to file such misconceived applications before the High Court when already the Hon'ble Supreme Court is seized of it.
